End User License Agreement

IMPORTANT — READ CAREFULLY BEFORE INSTALLING OR USING THIS SOFTWARE.

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Auroptic LLC ("Company") for the use of GuitarTrainer software ("Software"), including all associated program files, data files, and documentation.

BY CLICKING "I AGREE" DURING INSTALLATION, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE SOFTWARE.

1Grant of License

Subject to the terms of this Agreement, Auroptic LLC grants you a non-exclusive, non-transferable license to install and use one (1) copy of the Software on a single personal computer owned or controlled by you, for your personal, non-commercial use.

2Activation and Machine Binding

The Software requires a one-time online license activation. Upon entering your license key, the Software contacts Auroptic LLC's licensing server to verify the key and binds the license to the hardware of the computer on which it is activated. An internet connection is required at the time of activation. After activation the Software operates fully offline.

The same license key may not be used to activate the Software on a second computer. If you need to transfer your license to a new computer, contact Auroptic LLC for assistance.

3Trial Use

Prior to purchase, the Software may be used on a trial basis for up to ten (10) sessions. Trial use is limited to Beginner difficulty and frets 0 through 5, with a maximum of 10 trials per zone. After ten sessions, a license key is required to continue.

4Hardware and System Requirements

The Software requires a Windows 10 or Windows 11 computer, an audio interface capable of 48kHz sample rate, and an electric guitar equipped with passive magnetic coil pickups, or an acoustic guitar equipped with a passive magnetic coil pickup. A standard instrument cable and an available USB port are also required.

ACTIVE PICKUPS ARE NOT COMPATIBLE WITH THIS SOFTWARE. Guitars equipped with active pickup systems (battery-powered preamp circuits) are not supported and will not function correctly with the pitch detection system.

Auroptic LLC is not responsible for any costs incurred by the User in acquiring hardware, equipment, or third-party software for use with the Software. System requirements are published at auropticgt.com and the User is solely responsible for verifying compatibility before purchase.

5Restrictions

You may not:

Copy, distribute, sell, sublicense, or transfer the Software or your license rights to any third party;
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except to the extent expressly permitted by applicable law;
Modify or create derivative works based on the Software;
Remove or alter any proprietary notices, labels, or marks on the Software;
Use the Software for any commercial purpose, including but not limited to resale or provision of services to third parties.

6Ownership

The Software is licensed, not sold. Auroptic LLC retains all right, title, and interest in and to the Software, including all intellectual property rights. This Agreement does not convey any ownership interest to you.

7Audio Output and Headphone Safety Warning

THE SOFTWARE PRODUCES AUDIO OUTPUT INCLUDING PIANO TONES AND MUSICAL PHRASES. LISTENING TO AUDIO AT HIGH VOLUME LEVELS, PARTICULARLY THROUGH HEADPHONES OR EARBUDS, CAN CAUSE PERMANENT HEARING DAMAGE.

THE SOFTWARE DEFAULTS TO A LOW MASTER VOLUME SETTING AS A PRECAUTIONARY MEASURE. YOU ARE SOLELY RESPONSIBLE FOR SETTING AND MAINTAINING A SAFE LISTENING VOLUME AT ALL TIMES. Auroptic LLC STRONGLY RECOMMENDS STARTING WITH THE MASTER VOLUME CONTROL AT ITS DEFAULT LEVEL AND INCREASING GRADUALLY. NEVER USE THE SOFTWARE AT HIGH VOLUME LEVELS THROUGH HEADPHONES FOR EXTENDED PERIODS.

Auroptic LLC DISCLAIMS ALL LIABILITY FOR HEARING DAMAGE OR OTHER INJURY RESULTING FROM THE USE OF THE SOFTWARE AT EXCESSIVE VOLUME LEVELS.

8Data Privacy and Local Storage

GuitarTrainer stores session usage data in an encrypted file on your local computer. This data includes session counts, cumulative practice time, and license activation information. This data is never transmitted to Auroptic LLC or any third party automatically.

The only external communication the Software makes is a one-time license key verification request to Auroptic LLC's licensing server at the time of activation. No personal data, session data, or usage statistics are transmitted during this request or at any other time.

The Software provides an option to export session data as a JSON file. If the User chooses to submit this exported data to a third-party service, including artificial intelligence language models, Auroptic LLC is not responsible for how such third-party services handle, store, or process that data. Such use is entirely at the User's discretion and risk.

In the event of a support or refund request, Auroptic LLC may ask the User to provide their locally stored usage data file (usage.agt) to assist in evaluating the request.

9Refund Policy

Auroptic LLC offers a full refund within 14 days of purchase if the Software cannot be successfully installed or activated on your computer through no fault of the User. Refund requests must be submitted to [email protected] with a description of the issue encountered.

Because the Software includes a free 10-session trial prior to purchase, refunds are not available on the basis of dissatisfaction with the Software's features, effectiveness, or musical results. Individual results will vary depending on the User's existing skill level, practice habits, and commitment to use.

Refund requests occurring after a License Key was activated and verified must include the locally stored usage data file (usage.agt). If this file cannot be provided, Auroptic LLC reserves the right to deny the refund request.

10Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. Auroptic LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Auroptic LLC DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, OR BE ERROR-FREE.

Auroptic LLC MAKES NO REPRESENTATIONS OR GUARANTEES REGARDING MUSICAL PROGRESS, SKILL DEVELOPMENT, OR ANY OTHER RESULTS THAT MAY OR MAY NOT BE ACHIEVED THROUGH USE OF THE SOFTWARE.

11Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Auroptic LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF Auroptic LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Auroptic LLC'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.

12Termination

This Agreement is effective until terminated. It will terminate automatically if you fail to comply with any of its terms. Upon termination, you must destroy all copies of the Software in your possession. Sections 5 through 13 survive termination.

13Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.

14Entire Agreement

This Agreement constitutes the entire agreement between you and Auroptic LLC with respect to the Software and supersedes all prior or contemporaneous understandings, communications, and agreements, whether written or oral, relating to the Software.
